First, strengthen the deployment and implementation to create a good start for the construction safety work of the "12th five-year Plan".
2011 is the first year of the 12th five-year Plan, and it is also the 90th anniversary of the founding of Communist Party of China. It is of great significance to do a good job in construction safety production this year. All localities should conscientiously do a good job in deployment and implementation in accordance with the spirit of the "circular" and in the light of local reality. In continuing to carry out the activities of the "year of production Safety", we should take the spirit of the Circular of the State Council on further strengthening the work of production Safety in Enterprises (Guofa (2010) No. 23) as the core and strengthen the responsibility of the main body of production safety in enterprises. we will deepen the "three actions" of law enforcement, governance, propaganda and education in production safety, and the "three construction" of legal system mechanism, guarantee capacity, supervision and supervision team. We will actively prevent and effectively contain serious and serious accidents, promote the sustained, steady improvement of the construction safety production situation, and create a good foundation for construction safety production work in the first year of the 12th five-year Plan.
Second, implement the main responsibility of enterprises and earnestly strengthen the work of construction safety in production.
All localities should conscientiously implement the spirit of document No. 23 of the State Council Guofa [2010] and the requirements of our Ministry's implementation opinions, and formulate specific implementation measures for each work requirement in the light of local realities. It is necessary to guide and urge enterprises to establish and improve production safety management rules and regulations, and ensure that safety investment, safety management, technical equipment, education and training, and other measures are implemented. It is necessary to earnestly implement the main responsibility of the enterprise for production safety, especially to strengthen the responsibility of the legal representative of the enterprise who is first responsible for production safety. It is necessary to formulate and strictly implement the on-site shift leadership system for leading cadres in enterprises and construction sites. For a project under construction, the person in charge of the construction enterprise or the person in charge of the project, the person in charge of the supervision enterprise or the person in charge of the project supervision shall lead the shift at the site, and go to work and leave work at the same time as the workers. If the responsible person concerned fails to perform his duties, he shall be dealt with as absent from his post, and the economic penalty of the prescribed upper limit shall be imposed. If an accident occurs and there is no responsible person to lead the shift on the spot, the enterprise shall be given an economic penalty of the prescribed upper limit, and the principal responsible person of the enterprise shall be severely investigated for responsibility in accordance with the law. It is necessary to formulate and implement a major hidden danger listing supervision system, and provincial housing urban and rural construction departments should carry out listed supervision on the management of major hidden dangers. Enterprises should regularly carry out security hidden trouble investigation. For major hidden dangers, the person in charge of the enterprise should supervise the rectification and reform on the spot to ensure that the hidden dangers are eliminated. It is necessary to formulate and implement a supervision system for the investigation and handling of production safety accidents. The investigation and handling of major accidents is directly supervised by the Ministry of Housing and Urban-Rural Construction, the larger accidents are supervised by the provincial housing urban-rural construction departments, and other accidents are supervised by the provincial housing urban-rural construction departments. The investigation and handling of accidents should be reported in the media and subject to social supervision.
Third, do a good job in the "four combinations" and further strengthen supervision and inspection
All localities should conscientiously carry out special rectification, investigation and treatment of hidden dangers, focusing on deep foundation pit and scaffolding, so as to eliminate the hidden dangers existing in the construction site in a timely manner. The inspection work should achieve the "four combinations". First, with the combination of comprehensive inspection and key inspection, we should not only strengthen comprehensive supervision and inspection, but also strengthen supervision and inspection of key projects, key projects, and key areas with poor security situation. Second, the combination of self-inspection and random inspection requires enterprises at the grass-roots level not only to strengthen their own inspection, but also to organize forces to conduct spot checks on projects and construction sites in areas under their jurisdiction. Third, with the combination of regular inspection and centralized special inspection, we should not only organize regular supervision and inspection, but also specially organize forces to carry out centralized special supervision and inspection on outstanding and special problems. Fourth, the combination of open investigation and covert investigation, we should not only have notice and prepared supervision and inspection, but also covert inspection without notice, so as to really find problems and really eliminate security risks.
Fourth, step up law enforcement and strictly investigate and deal with illegal acts and accidents
All localities should strengthen the supervision and law enforcement of construction enterprises and severely crack down on illegal activities in construction in accordance with the law. It is necessary to achieve "three reinforcements and equal emphasis on three", that is, to strengthen the supervision and inspection of law enforcement, to attach equal importance to legislation and law enforcement supervision and inspection, to strengthen the management of market clearance, and to pay equal attention to both market access management and market clearance management. strengthen the dynamic management of qualification examination and approval, and pay equal attention to qualification examination and approval and follow-up dynamic management. It is necessary to seriously rectify and standardize the order of the construction market, and severely crack down on various violations of laws and regulations, such as project subcontracting, illegal subcontracting, and reducing reasonable construction periods. It is necessary to promptly report the investigation and handling of illegal enterprises in the news media, guide the market and owners to select honest enterprises and enterprises with good quality and safety performance.
We must attach great importance to the investigation and handling of accidents, and strictly investigate and deal with the responsible units and persons for each accident in accordance with the principle of "four no-let-go" and the requirements of seeking truth from facts, complying with laws and regulations, and focusing on practical results. For enterprises that commit illegal activities, their enterprise qualification certificates and production safety licenses that should be revoked according to law must be revoked, those that should be downgraded must be demoted, those that should be temporarily withheld must be temporarily withheld, and those that should be cleared out of the construction market must be cleared out of the market in a timely manner. For registered practitioners who commit illegal activities, their certificates must be revoked if their certificates should be revoked according to law, and those that should be stopped practicing must be stopped. At the same time, all localities must strengthen the reporting of accident investigation and handling, and promptly report the punishment of each major or above accident to our ministry.
5. Strengthen basic work and actively promote the construction of long-term production safety mechanisms
All localities should combine the actual conditions of the region, strengthen the construction of laws and regulations, study and formulate relevant rules and regulations, and further improve the construction of local regulations and standard systems for building safety production. It is necessary to actively carry out production safety publicity and education activities with strict implementation of laws, regulations, standards and specifications as an important content, and promote the whole society to pay attention to and attach importance to construction safety production. It is necessary to strengthen the construction of construction safety supervision institutions and teams, and effectively improve the professional quality of safety supervision personnel and the level of administration according to law and strict law enforcement. It is necessary to increase the guarantee of building safety production costs, strengthen research on production safety science and technology, increase investment in production safety, continuously improve enterprise safety production capabilities and government safety supervision effectiveness, and comprehensively improve the level of building safety production management.
