The main person in charge (Certificate A) shall be appointed according to the personnel appointment decision of the enterprise, and the project leader (Certificate B) shall be carried out according to the minimum qualification application, and the full-time production safety management personnel (Certificate C) shall be carried out with reference to document (2008) 91 of the Ministry of Construction.
The first application and extension application of a general contractor and a professional contracting company must have the project leader (b certificate) on the issuance of the "measures for the Establishment of production Safety Management institutions and full-time production Safety Management personnel in Construction Enterprises". Article 1 in order to standardize the establishment of production safety management institutions in construction enterprises, clarify the equipment standards of full-time production safety management personnel in construction enterprises and projects These measures are formulated in accordance with the Law of the people's Republic of China on production Safety, the regulations on the Administration of production Safety in Construction projects, the regulations on production Safety licenses and the regulations on the Administration of production Safety licenses for Construction Enterprises.
Article 2 these measures shall apply to the establishment of production safety management institutions and full-time production safety management personnel of construction enterprises engaged in new construction, reconstruction, expansion and demolition of civil engineering, construction projects, installation of lines, pipelines and equipment and decoration projects.
Article 3 the term "production safety management organization" as mentioned in these measures refers to the independent functional departments set up by construction enterprises in charge of production safety management.
Article 4 the term "full-time production safety management personnel" as mentioned in these measures refers to the full-time personnel who have obtained the certificate of production safety assessment through the examination of production safety by the competent department in charge of construction or other relevant departments, and who are engaged in the management of production safety in construction enterprises and their projects.
Article 5 A construction enterprise shall set up an organization for the management of production safety in accordance with the law and carry out the management of production safety under the leadership of the principal responsible person of the enterprise.
Article 6 the administrative agencies for production safety of construction enterprises shall have the following responsibilities:
(1) to publicize and implement the relevant national laws, regulations and standards on production safety; (2) to formulate and timely update the production safety management system and supervise its implementation; (3) to organize or participate in the preparation and exercise of emergency rescue plans for production safety accidents in enterprises; (4) to organize and carry out safety education, training and exchanges; (5) to coordinate and equip full-time project safety management personnel. (6) to formulate production safety inspection plans for enterprises and organize their implementation; (7) to supervise the use of production safety costs for projects under construction; (8) to participate in expert discussions on special construction plans for safety projects with greater risks; (9) to report the investigation and handling of violations of laws and regulations of projects under construction; (10) to organize the work of evaluation and commendation of production safety in advance; (11) to establish production safety management files for projects under construction in enterprises. (12) to assess and evaluate the production safety performance of the subcontracting enterprise and the project safety production management; (13) to participate in the investigation and handling of production safety accidents; and (14) to specify other production safety management responsibilities of the enterprise.
Article 7 the full-time management personnel of production safety in the management institution of production safety of a construction enterprise shall have the following duties in the process of construction site inspection:
(1) to consult the relevant data on production safety of projects under construction and verify the relevant situation; (2) to inspect the implementation of special safety construction plans for projects with greater risks; (3) to supervise the performance of responsibilities of full-time safety management personnel of the project; and (4) to supervise the allocation and use of safety protective equipment for operators. (5) have the right to correct or make decisions on the spot to correct violations or hidden dangers of safety in production; (6) to make decisions on facilities, equipment and equipment that do not meet the conditions for production safety on the spot; (7) to report major safety risks at the construction site beyond the level or directly to the department in charge of construction.
(8) other clearly defined duties of production safety management of the enterprise.
Article 8 the full-time management personnel for production safety in the management institution of production safety of a construction enterprise shall meet the following requirements and shall be increased according to the business scale, equipment management and production needs of the enterprise:
(1) Construction general contractor qualification series enterprises: not less than 6 people with special qualification, not less than 4 with first-class qualification, and not less than 3 with second-level and lower-second-level qualification enterprises.
(2) A series of enterprises with professional contracting qualifications for construction: not less than 3 persons with first-class qualifications and no less than 2 persons with second-level and lower-second-level qualifications.
(3) Construction service subcontract qualification sequence enterprises: not less than 2 persons.
(4) larger branches such as branches and regional companies of construction enterprises (hereinafter referred to as branches) shall be equipped with not less than 2 full-time production safety management personnel according to the actual production situation.
Article 9 Construction enterprises shall implement the appointment system of full-time production safety management personnel for construction projects. The full-time production safety management personnel of construction projects shall report the project production safety management to the enterprise production safety management agencies on a regular basis.
Article 10 A construction enterprise shall set up a leading group on production safety in construction projects. Where a construction project is under general contracting, the leading group for production safety shall be composed of project managers, technical responsible persons and full-time production safety management personnel of general contracting enterprises, professional contracting enterprises and labor subcontracting enterprises.
Article 11 the main duties of the leading group on production safety are as follows:
(1) to implement the relevant national laws, regulations and standards on production safety; (2) to organize the formulation of project production safety management system and supervise its implementation; (3) to formulate emergency rescue plans for project production safety accidents and organize drills; (4) to ensure the effective use of project safety production costs; (5) to organize the preparation of special construction plans for safety projects with greater risks; and (6) to carry out project safety education and training. (7) to organize the implementation of project safety inspection and investigation of hidden dangers; (8) to establish project safety production management files; and (9) to report production safety accidents in a timely and truthful manner.
Article 12 full-time production safety management personnel of the project shall have the following main responsibilities:
(1) Responsible for daily inspection of production safety on the construction site and keeping inspection records;(2) Supervise the implementation of special construction plans for safety of dangerous projects on site;(3) Have the right to correct or investigate violations of regulations and regulations by operators;(4) Have the right to order immediate rectification of potential safety hazards existing on the construction site;(5) Have the right to report major potential safety hazards discovered to the enterprise's production safety management agency;(6) Report production safety accidents in accordance with the law.
Article 13 The general contractor shall equip full-time production safety management personnel for the project with the following requirements:
(1) Construction projects and decoration projects are equipped according to the building area:
1. No less than 1 person for projects below 10,000 square meters;2. No less than 2 people for projects ranging from 10,000 to 50,000 square meters;3. No less than 3 people for projects ranging from 50,000 square meters and above, and they are equipped according to their specialties. Full-time production safety management personnel.
(2) Civil engineering, lines, pipelines, and equipment installation projects shall be equipped according to the project contract price:
1. No less than 1 person in projects with less than 50 million yuan;2. No less than 2 people in projects with 50 million yuan to 100 million yuan;3. No less than 3 people in projects with 100 million yuan and above, and they are equipped with full-time safety production management personnel according to their majors.
Article 14 The subcontracting unit shall equip full-time project safety management personnel with project safety management personnel shall meet the following requirements:
(1) A professional contracting unit shall allocate at least one person and increase it according to the quantity and construction risk of the divisional and sub-item projects undertaken.
(2) If the labor subcontracting unit has less than 50 construction personnel, it shall be equipped with 1 full-time production safety management personnel; if the number of construction personnel is 50 to 200, it shall be equipped with 2 full-time production safety management personnel; if the number of construction personnel is 200 or more, it shall be equipped with 3 or more full-time production safety management personnel, and shall increase according to the actual situation of the sub-project construction risks, and shall not be less than 5‰ of the total number of project construction personnel.
Article 15 For engineering projects that adopt new technologies, new processes, new materials or many harmful factors and difficult construction operations, the number of full-time production safety management personnel for the project shall be increased according to the actual construction conditions and in accordance with the provisions of Articles 13 and 14. The equipment standards stipulated in Articles 14 shall be increased.
Article 16 A construction operation team may have part-time safety inspectors to conduct safety supervision and inspection of the team's workplace.
Construction enterprises shall regularly conduct safety education and training for part-time safety inspectors.
Article 17 When issuing production safety licenses, the production safety license issuing and management authority shall review the establishment of the production safety management institution of the construction enterprise and the allocation of full-time production safety management personnel.
Article 18 When issuing a construction permit or approving the commencement report, the competent construction department shall review the allocation of full-time production safety management personnel for the project.
Article 19 The competent construction department shall supervise and inspect the performance of the production safety management agency of a construction enterprise and its full-time production safety management personnel.
Article 20 These Measures shall come into effect as of the date of promulgation, and the "Measures for the Establishment of Production Safety Management Institutions and the Allocation of Full-time Production Safety Management Personnel of Construction Enterprises" in the original "Notice on Printing and Issuing"(Jianzhi [2004] No. 213) shall be repealed.
